Terms of Service for DJ Comp 1 — Coach Sazz

These Terms of Service (“Terms”) govern your access to and use of the Coach Sazz health tracking application (the “Service”) operated by DJ Comp 1 (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use the Service.
1. Eligibility
You must be at least 13 years old (or 16 in the EU/EEA) to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
2. Account Registration
To use Coach Sazz, you must create an account. When registering, you agree to:
Provide accurate, current, and complete information
Maintain and update your information to keep it accurate
Keep your password secure and confidential
Accept responsibility for all activities that occur under your account
Notify us immediately if you suspect any unauthorized access to your account
We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or violates these Terms.
3. Description of the Service
Coach Sazz is a personal health tracking application that allows you to log and monitor:
Body weight
Blood pressure and pulse
Blood sugar and A1C
Diet (foods, calories, macronutrients)
Water intake
Optional notes
The Service may also offer meal plans, dietary recommendations, and quality scores based on your logged data.
Coach Sazz is an information and tracking tool. It is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition.
4. Health Disclaimer
THE SERVICE IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR MEDICAL CONDITION.
The health tracking features, meal plans, dietary recommendations, macro targets, and quality scores provided by the Service are for informational and educational purposes only. They do not constitute:
Medical advice
A substitute for professional medical care
A basis for self-diagnosis or self-treatment
A replacement for consultation with a qualified healthcare provider
Always consult a qualified healthcare professional before:
Making changes to your diet, exercise routine, or medication
Interpreting any data, trend, or score shown in the Service
Making decisions about your health based on information from the Service
If you think you may have a medical emergency, call your doctor, go to the emergency department, or call 911 (or your local emergency number) immediately. The Service does not support emergency communications.
Never disregard professional medical advice or delay in seeking it because of something you have read or interpreted in the Service.
5. Subscription and Payment
5.1 Free Trial
New accounts receive a 30-day free trial. No payment is required during the trial. You may cancel at any time during the trial without charge.
5.2 Paid Subscriptions
After the free trial ends, continued use of the Service requires a paid subscription. Subscription fees and billing terms are presented to you at the time of purchase.
By subscribing, you agree to pay the applicable subscription fees. All fees are non-refundable except where required by law.
5.3 Payment Processing
Payments are processed by Stripe (https://stripe.com). By providing payment information, you agree to Stripe’s Terms of Service and Privacy Policy. We do not store your full credit card number or CVV.
5.4 Auto-Renewal
Subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your selection) unless you cancel before the renewal date. You may cancel at any time from your account settings.
5.5 Price Changes
We may change subscription prices at any time. If we change the price of your subscription, we will notify you at least 30 days in advance. The new price will apply at the start of your next billing period after the change. If you do not agree to the new price, you may cancel your subscription.
5.6 Taxes
Subscription fees are exclusive of any applicable taxes. You are responsible for any taxes associated with your subscription.
6. Acceptable Use
You agree NOT to:
Use the Service for any illegal purpose or in violation of any applicable laws
Attempt to gain unauthorized access to the Service, other users’ accounts, or any related systems
Interfere with or disrupt the Service or its security features
Upload viruses, malware, or any other malicious code
Scrape, crawl, or use automated tools to access the Service without our written permission
Impersonate any person or entity, or falsely represent your affiliation with any person or entity
Use the Service to harass, abuse, or harm another person
Use the Service to send spam or unsolicited communications
Reverse engineer, decompile, or attempt to extract the source code of the Service
Remove or alter any proprietary notices or labels on the Service
7. Intellectual Property
The Service and its original content, features, and functionality are owned by DJ Comp 1 and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of any data you submit to the Service (your health entries, notes, etc.). By submitting data, you grant us a limited, non-exclusive, royalty-free license to use, store, and process that data solely to provide the Service to you.
8. Data Backup and Loss
We take reasonable measures to back up your data, but we do not guarantee against data loss. You are responsible for maintaining your own backups of important data. You may export your data as a CSV file at any time from the Service.
9. Termination
9.1 By You
You may terminate your account at any time by following the instructions in your account settings or by contacting us. Upon termination, your data will be deleted from our active database within 30 days, subject to our data retention practices (see our Privacy Policy).
9.2 By Us
We reserve the right to suspend or terminate your account at any time, with or without cause, with or without notice. Reasons for termination may include:
Violation of these Terms
Non-payment of subscription fees
Fraudulent, abusive, or illegal activity
Extended inactivity (12+ months without login)
If we terminate your account for cause, you will not be entitled to a refund of any prepaid fees.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA.
We do not warrant that:
The Service will be uninterrupted, error-free, or secure
The results obtained from the Service will be accurate or reliable
The quality of any information obtained through the Service will meet your expectations
Any errors in the Service will be corrected
You acknowledge that health tracking data and dietary recommendations are inherently uncertain and that the Service is provided as a tool to assist your own decision-making, not to replace it.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DJ COMP 1, ITS OWNERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
Your access to or use of (or inability to access or use) the Service
Any conduct or content of any third party on the Service
Any health-related decision made based on information from the Service
Unauthorized access, use, or alteration of your data
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).
Some jurisdictions do not allow the limitation of liability for incidental or consequential damages, so the above limitation may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless DJ Comp 1 and its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:
Your use of the Service
Your violation of these Terms
Your violation of any third party’s rights
Any health-related decision you make based on information from the Service
13. Dispute Resolution
13.1 Informal Resolution
Before filing any formal claim, you agree to contact us at legal@djcomp1.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute by contacting you via email. If a dispute is not resolved within 30 days, you or we may pursue formal resolution.
13.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
13.3 Jurisdiction
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you hereby consent to the personal jurisdiction of such courts.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email and/or by posting a notice in the Service. The “Last updated” date at the top reflects when these Terms were last revised. Continued use of the Service after a change constitutes acceptance of the updated Terms.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DJ Comp 1 regarding the Service and supersede any prior agreements.
